Sam Lutfi's lawsuit against Britney Spears has been thrown out by a judge.
'The X Factor' judge and her parents - who were being sued by Sam for breach of contract, defamation and assault - were told in a Los Angeles courtroom yesterday (01.11.12) that they did nothing wrong and the scorned celebrity manager was told he had no case against them.
Sam had accused the 30-year-old star of breach of contract claiming they verbally agreed he would represent her for four years around the time of her public meltdown four years ago.
He had also filed a battery claim against her father Jamie and was suing her mother Lynne for defamation relating to comments she made about him in her 2008 memoir 'Through The Storm'.
Earlier this week the family had filed legal documents petitioning the judge to dismiss the lawsuit stating Britney never gave her ''reciprocal assent'' to pay Lutfi 15 per cent of her income in exchange for his managerial services during the period, which Sam claimed during his testimony in court last week.
And, as for the battery allegation, the family's legal team argued Sam ''has not presented clear and convincing evidence that Jamie Spears acted either with intent to injure him''.
Sam claimed Jamie hit him in the solar plexus and threatened to kill him on the morning of January 29, 2008, hours after Britney was photographed and videotaped crying outside her home after jumping out of a car being driven by Sam.
He also claimed Britney shaved off her hair because she was afraid it would be used as evidence of her drug use.
Sam - who currently represents Courtney Love - told gossip website TMZ.com he plans to appeal the judge's decision.
