Actor Leonardo Dicaprio is being sued by his neighbors for allegedly damaging their property during the construction of his basketball court.

Dicaprio rents his Hollywood Hills home from his cousin Robert Hrtica, who is also named in the suit filed by neighbors Ronald and Joan Linclau last May. The Linclau's claim that Dicaprio "maliciously" cut and removed hedges, excavated "earth, granite and bedrock", destabilizing their deck and swimming pool, and ignored the family's requests to stop the construction.

The case is being heard by Los Angeles Judge Tricia Ann Bigelow. Bigelow originally denied the lawsuit saying that the suit was inadequate and failed to prove that Dicaprio did anything wrong.

As of Thursday, the neighbors adjusted their lawsuit and Bigelow gave the go ahead for the case. Bigelow will make the final ruling on the case on a court date that has yet to be announced.

The Linclau's are suing for trespass, nuisance and negligence. They are seeking $250,000 in compensation.
