Kevin Federline's lawyer says it's not certain that Britney's children are going on tour. Mark Vincent Kaplan has revealed that an agreement is yet to be reached on whether three-year-old Sean Preston and Jayden James, two, will go on the road with their mother.

He said: "There can be an agreement reached in probably the next day, but there is not an agreement that is signed yet."

Pop star Britney Spears will cancel her 'Circus' tour unless her children can accompany her. The 'Womanizer' singer is reportedly refusing to go on the 33-date tour if her ex-husband Kevin Federline's lawyers continue stopping her from taking their children - Sean Preston, three, and Jayden James, two - with her. Britney is so desperate to be near her children she is intending to set up bases for them in New Jersey, New Orleans and Los Angeles so she can visit them in between shows. She will also pay for her ex-husband's accommodation.

A source said: "Kevin has been staying over a lot but I don't think it will be long until they are living together full-time again. They have slipped back into their old relationship really easily."
