The divorce between Kevin Federline and Britney Spears is not yet final and if the pop star continues to party it won't be for a while.
K-Fed is reportedly stalling on the proceedings because he is waiting to see if his estranged wife slips up again - if she relapses and goes on another partying rampage like she did wheny the first split, then Kevin may have more leverage when seeking custody of the children.
Earlier this year, the young couple reached an agreement to share legal and physical custody of sons Sean Preston and Jayden James. When the divorce began, both parties were seeking full custody.
A source told PEOPLE, "Britney's attorneys are anxious to see Kevin sign off on a divorce. But Kevin and his lawyer Mark Vincent Kaplan are dragging their heels out of concern over reports of Britney's post-rehab partying."
Britney's previous behavior has seen her party nightly, shave her head and wind up in rehab. K-Fed, apparently, "wants to make sure that the divorce document makes it simple enough for Kevin to downsize Britney's access to her kids the next time her behavior troubles him."
Kevin looked after the two young boys while Britney was in rehab.
