Nick Bollea, Hulk Hogan's son, will remain in solitary confinement after a judge refused his lawyers' request to transfer him to home confinement.

The 17-year-old's attorneys argued that the solitary confinement was "cruel and unusual punishment" for a minor like him. They are bidding for a home confinement instead in time for him to celebrate his birthday on July 27.

He is currently serving his eight-month sentence in jail for his involvement in a car accident in August that left his friend John Graziano in a critical condition.

However, Judge Philip I. Federico denied the request. He did not disclose his reasons for the decision.

The former professional wrestler's son spends 16 to 17 hours a day in the maximum-security cell where his food is delivered through a slot in the door. According to his lawyers, this has been causing him "unbearable anxiety."

Meanwhile, Bollea is suing the sheriff's office for invading his privacy by releasing to the media tapes of his jail conversations with his parents.
